Yesterday, Dr. Orly reported that one of her readers had written her regarding a possible "citizen's arrest" of Obama.
While Wicked Pedia can be wrong on some touchy subjects, they are correct on this one. Every person can be arrested by citizens of this country, if he is committing felony. Forgery of documents, perjury, social security fraud are all felonies and BO can be arrested by the citizens of this country. He is not above the law. The only state that does not officially allow citizens arrest, is North Carolina. If BO doesn’t intend on sitting for the rest of his term in NC, he can be arrested by the citizens of this country.
But her reader appeared to miss one teeny-tiny detail. From the actual article:
Each state, with the exception of North Carolina permits citizen arrests if the commission of a felony is witnessed by the arresting citizen, or when a citizen is asked to assist in the apprehension of a suspect by police. The application of state laws varies widely with respect to misdemeanors, breaches of the peace, and felonies not witnessed by the arresting party. American citizens do not carry the authority or enjoy the legal protections of police, and are held to the principle of strict liability before the courts of civil- and criminal law including but not limited to any infringement of another's rights.
Translation--someone would have actually had to see Obama forging documents, making plans to lie under oath or commit Social Security fraud to make an arrest. But we wouldn't expect someone who got her law degree from an online degree mill to know that.
The scary part is that someone in the teabagging crowd just might be crazy enough to actually take Dr. Orly up on her advice and try to arrest Obama. Then again, it would make it a lot easier to get this crazy woman disbarred.
